The drafters of the Federal Rules of Civil Procedure were exceedingly wise.  They gave us a mechanism to get rid of bogus claims like this expeditiously and inexpensively.

Rule 12(b)(6), do your stuff.

Doesn't that work like in Europe where the other companies can still use the technology if they already had products before the patent was granted?

I'm not an IP lawyer, but my non-specialist's understanding is that "prior art" and "obviouslness" are grounds for the USPTO to reject a patent application, and can also form the basis for defense of an infringement case (event if the patent was granted).

Okay guys, does anyone have contacts UE (of course) or Westone, or Shure? There are probably some old hats there who could give specific examples of prior use. I can pass along anything anonymously over to 1964ears (yes, I wrote them and they welcome the help).

Well, to be precise, JH started UE and contracted with Westone to make products for UE. I could go on, but varying perspectives could say JH is sensitive and aggressive in this regard due to prior transgressions against his enterprises, so he's playing the same game. It's business and personal, I'll just leave it there.

This is very strange. The patent was filed in 2010. Harvey was at UE making multi-driver IEMs way before the filing of the patent. The question is if the patent is even valid. Why didn't Harvey file for the patent when he was at UE? I wonder if UE has a similar patent. I'm sure when UE sold to Logitech in 2007, Logitech insisted on having ownership of all existing IP.

I'll let you detectives do the work.

Lawyers are like patent portfolio investment bankers. JH could do worse and seek representation by one of the larger patent troll firms.
